Cohabiting couple?  If you are a co-habiting couple, although the legal system contains some protection in the event of death or relationship breakdown (“cohabitee divorce”), we do recommend that you enter into some form of written agreement to deal with what would happen in these events.

You might have bought a house together and furnished it and carried out various improvements.  If the title deed says you own the house equally, then without an agreement it will be difficult to argue with the 50/50 split on sale, even if one person has paid for thousands of pounds worth of repairs.  The owner of the washing machine will the person whose name is on the receipt, even if you used joint money to pay for it.  If you do not have a survivorship clause in the title and have not made wills, if one person dies their families will be able to claim half the house.

Prevent all these problems by coming to us to have an agreement drawn up, and making sure your wills deal properly with the situation.
